This legal notice is drawn up in accordance with Article 6-III of French Law No. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN) and Article 19 of the same law, applicable to websites accessible from France.

5. Intellectual property
All elements making up the websites and the BIRP Platform (architecture, source code, texts, trademarks, logos, graphic identities, illustrations, databases and documentation) are protected by intellectual property law and remain the exclusive property of BIRP SOFTWARE S.R.L. or its licensors.
Any reproduction, representation, adaptation, modification, extraction or reuse, in whole or in part, by any process and on any medium whatsoever, is prohibited without BIRP’s prior written authorisation, subject to legal exceptions and to the rights of use granted under the General Terms.
The trademarks and logos of third parties reproduced on the websites, in particular those of clients and partners, remain the property of their respective owners and are used with their authorisation.
6. Personal data
The processing of the personal data of visitors and users is described in the Privacy Policy, accessible from the footer of the websites.
Any question relating to data protection may be addressed to privacy@birp.io.
7. Cookies and trackers
The trackers placed on the websites, their purposes, their lifetimes and the ways consent is collected and withdrawn are described in the Policy on cookies and trackers, accessible from the footer of the websites and from the permanent "Manage my cookies" link.
8. Terms of use and liability
Access to the websites and use of the Platform are governed by BIRP’s General Terms.
BIRP strives to ensure that the information published on its websites is accurate and up to date, without being able to guarantee its completeness or the absence of errors. The general information appearing on the websites constitutes neither advice nor a contractual commitment.
The websites may contain links to third-party websites. BIRP exercises no control over such websites and declines all liability for their content and their data practices.
BIRP cannot be held liable for damage resulting from a temporary unavailability of the websites, an intrusion, a technical malfunction or the presence of a virus, without prejudice to the obligations undertaken under the General Terms and the service levels stipulated therein.
9. Points of contact under the Digital Services Regulation
Insofar as the BIRP Platform stores information provided by its clients and at their request, it may fall within the qualification of a hosting service within the meaning of Article 3(g)(iii) of Regulation (EU) 2022/2065 on digital services. BIRP is, however, not an online platform within the meaning of Article 3(i) of that Regulation: the stored information is not disseminated to the public, but remains confined to the environment of the client that provided it.

The restrictions imposed on the use of the Platform and in relation to the information provided by clients, as well as the procedures for handling reports, are stipulated in BIRP’s General Terms.
10. Consumer mediation
BIRP’s services are intended exclusively for professional use. The consumer mediation scheme provided for in Articles L. 611-1 et seq. of the French Consumer Code is therefore not intended to apply.
11. Governing law and jurisdiction
This legal notice is governed by French law.
Any dispute relating to the websites falls within the jurisdiction of the competent courts of Paris (France), subject to the mandatory jurisdiction rules applicable, in particular those protecting consumers.
